Romney DoesN't Like Anything That Isn't White.


Campaigning in Puerto Rico, Mitt Romney is refusing to back off criticism of Supreme Court Justice Sonia Sotomayor.

The justice, nominated by President Barack Obama in 2009, is beloved by local Democrats and Republicans as the high court's first member of Puerto Rican descent.

"In looking at Justice Sotomayor, my view was her philosophy is quite different than my own and that's the reason why I would not support her as a justice for the Supreme Court," Romney said. "I would be happy to have a justice of Puerto Rican descent or a Puerto Rican individual on the Supreme Court, but they would have to share my philosophy, that comes first."

The issue puts Romney at odds with a majority of local voters and his most prominent Puerto Rican supporter, Gov. Luis Fortuno. It also underscores the challenges facing Republican candidates as they bring popular conservative rhetoric to an area packed with Hispanic voters ahead of Sunday's GOP president primary.
Beyond Sotomayor, Romney and his rival Rick Santorum have supported the conservative push to formalize English as the official language across the country. In Puerto Rico, an American territory that will vote on its political status, including statehood on Nov. 6, most residents speak Spanish as their primary language.
Santorum made headlines earlier in the week after suggesting that Congress would require Puerto Rico to adopt English as the official language as part of its quest for statehood, a dominant political issue here.

GOP Packed Supreme Court To Make Move To Add To The New System Of Jim Crow.


Affirmative action is heading back to the Supreme Court, and this time its prospects for survival are poorer than ever.

The Court announced on Tuesday that it has agreed to hear a challenge to the University of Texas' affirmative action program, which is used in sorting through applications after the automatic admission of all in-state applicants who graduated in the top 10 percent of their high school class.

The state's top 10 percent law was passed as a race-neutral way of facilitating diversity on campus after a federal appeals court in 1996 banned affirmative action in Texas' public universities. Then in 2003, the U.S. Supreme Court -- in a majority opinion written by Justice Sandra Day O'Connor for herself and the Court's four liberals -- approved of certain types of race-conscious admissions practices in higher education for the purpose of achieving a diverse student body. In response, the University of Texas reinstated affirmative action, this time to assess applicants who would not be automatically admitted under the top 10 percent law.

Man Gets New Trail After White Prosecutor withheld Evidence.


A Louisiana man convicted of killing five people during an armed robbery will get a new trial after the U.S. Supreme Court ruled Tuesday that prosecutors withheld key evidence that may have led to acquittal.

Juan Smith was convicted based on a single piece of evidence: an eyewitness who survived a shooting rampage committed by a group of men, several of whom were masked. While appealing in state court, Smith obtained statements by the witness to detectives indicating he could identify none of the men involved in the robbery.

The witness, Larry Boatner, later picked Smith in a photo lineup after seeing a newspaper picture that identified him as a suspect in the murders.
